Overview

Mental incapacity can arise suddenly or progressively, often leaving families facing uncertainty, delay, and costly court proceedings if proper planning has not been made.

This seminar will explore the legal framework governing mental incapacity in Hong Kong and examine key planning tools available to practitioners advising individuals and families, including committee-ship, guardianship, Enduring Powers of Attorney, Advanced Directives, and trust structures.

A structured Q&A session will conclude the seminar, along with networking.

Speakers

Billy Ko is a Partner in the Family Team at Withers, specialising in complex family, mental capacity, and elder law matters. He is recognised for his expertise in high-value financial disputes, trusts and sophisticated asset holding structures, and cross-border family issues. Billy is a leading practitioner in mental capacity law, advising on committee-ship, guardianship, and Enduring Powers of Attorney, and has acted in landmark Hong Kong cases in this area.

Billy is consistently recognised across top legal directories, holding a Litigation Star designation from Benchmark Litigation Asia Pacific 2025, ranked in Chambers High Net Worth and Chambers Greater China Region, and listed as a Recommended Lawyer in Doyle's Hong Kong Family & Divorce Lawyers Ranking. Deirdre Fu is a Partner in the Private Client and Tax Team at Withers, advising high net worth individuals, families, and institutional trustees on trust and succession planning, wealth protection, and long-term asset management. Her practice encompasses Hong Kong taxation, cross-border private wealth planning, incapacity planning, and employee share trust structuring. She is also a former Lecturer at the University of Hong Kong and holds the STEP Diploma in International Trust Management (Distinction).
